1. Agreement to Terms

By accessing or using the website located at www.trekcoaching.com (the “Website”), registering for an account, or purchasing any coaching services, you (“Client” or “User”) agree to be bound by these Terms & Conditions (“Terms”) and all applicable laws and regulations. These Terms constitute a legally binding agreement between you and Trek Global Executive Coaching, LLC (“Company,” “we,” “our,” or “us”), a limited liability company operating near Cincinnati, Ohio, United States.

If you do not agree with any part of these Terms, you must not access or use the Website or our services.

2. Services Offered

Trek Global Executive Coaching, LLC provides executive coaching services, including Forest Bathing sessions and related programming (collectively, the “Services”). Our Services are offered in the following formats:

• In-person Forest Bathing and coaching sessions conducted at designated outdoor locations
• Virtual coaching sessions conducted via video conferencing or other digital platforms
• Individual and group executive coaching engagements
• Garden design
• Custom presentations

All Service descriptions, availability, and pricing are subject to change at our sole discretion. We reserve the right to modify, suspend, or discontinue any Service at any time without notice.

3. User Accounts

To access certain features of the Website or to book Services, you may be required to create an account. By creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account at any time if we reasonably believe that you have violated these Terms or engaged in fraudulent or harmful activity.

4. Payments & Fees

All fees for Services are stated in U.S. dollars and are due at the time of booking unless otherwise agreed in writing. By providing payment information, you represent and warrant that you are authorized to use the payment method provided.

We use third-party payment processors to handle transactions. Your payment information is transmitted securely and is subject to the privacy policy and terms of service of the applicable payment processor. Trek Global Executive Coaching, LLC does not store full payment card details on its systems.

5. Cancellation & Refund Policy

5.1 Client Cancellations

We understand that schedules change. Our cancellation policy is as follows:

• Cancellations made at least 72 hours before a scheduled session are eligible for a full refund or credit toward a future session, at the Client’s election.
• Cancellations made less than 72 hours before a scheduled session are not eligible for a refund. The Company may, at its sole discretion, offer a credit toward a future session.
• No-shows (failure to attend without prior cancellation) are not eligible for refunds or credits.

5.2 Company Cancellations

In the event that Trek Global Executive Coaching, LLC must cancel a scheduled session due to inclement weather, unsafe outdoor conditions, illness, or other unforeseen circumstances, affected Clients will be offered a full refund or the opportunity to reschedule at no additional charge.

5.3 Third-Party Organized Sessions

Some Forest Bathing sessions offered through the Website or promoted by Trek Global Executive Coaching, LLC are organized, hosted, or facilitated by independent third-party organizers (“Third-Party Sessions”). For Third-Party Sessions, the cancellation and refund policy of the respective organizer will apply in lieu of the policy set forth in Section 5.1 above.

Trek Global Executive Coaching, LLC is not responsible for the cancellation policies, refund practices, or any fees imposed by third-party organizers. Prior to registering for any Third-Party Session, you are strongly encouraged to review and understand the applicable organizer’s cancellation and refund terms. Any disputes regarding cancellations or refunds for Third-Party Sessions must be directed to the organizer.

5.3 Requesting a Refund or Credit

To request a cancellation, refund, or credit, please contact us at least 72 hours in advance of your scheduled session via the contact form on the Website or by email. Refunds, when approved, will be issued to the original payment method within 7-10 business days.

6. Assumption of Risk — Outdoor & In-Person Sessions

PLEASE READ THIS SECTION CAREFULLY. By participating in any in-person Forest Bathing or outdoor coaching session, you acknowledge and agree to the following:

Participation in outdoor activities, including but not limited to Forest Bathing sessions conducted in natural environments, involves inherent risks, including but not limited to:

• Uneven terrain, roots, and natural ground hazards
• Exposure to insects, plants, wildlife, and environmental allergens
• Adverse weather conditions
• Physical exertion and fatigue
• Other risks associated with outdoor nature immersion

You voluntarily assume all such risks and hazards incidental to participation in these activities. You represent that you are in adequate physical health to participate and that you are aware of any medical conditions that may be affected by outdoor activity. You agree to inform Trek Global Executive Coaching, LLC of any relevant medical conditions prior to participation.

Nothing in these Terms shall be construed to waive liability for gross negligence or intentional misconduct.

7. Health & Wellness Disclaimer

The Services provided by Trek Global Executive Coaching, LLC are coaching services and are not a substitute for professional medical, psychological, therapeutic, or psychiatric advice, diagnosis, or treatment. Forest Bathing and executive coaching are intended for general wellness and professional development purposes.

If you have a physical or mental health condition, you should consult a qualified healthcare provider before participating in any of our Services. We are not responsible for any health-related outcomes resulting from participation in our programs.

8. Privacy & Data Collection

We are committed to protecting your personal information. By using the Website, you consent to our collection and use of your information as described below and in our Privacy Policy.

We may collect the following types of information:

• Contact information submitted via contact forms (name, email address, phone number)
• Account registration information
• Email addresses for newsletter and communications purposes
• Payment information (processed securely through third-party processors)

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TREK GLOBAL EXECUTIVE COACHING, LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE WEBSITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Trek Global Executive Coaching, LLC, its members, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorneys’ fees) arising out of or related to: (a) your use of the Website or Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any claim that your actions caused harm to another person.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Hamilton County, Ohio.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Website with an updated effective date. Your continued use of the Website or Services following the posting of revised Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically.

14. Severability

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
